These Terms are a legal agreement between you and Saving Augusta’s Littles (hereinafter referred to as "Website Owner"), the owner and developer of Savingaugustalittles.com and all courses, materials, tools, products, and/or services provided on Savingaugustalittles.com.  By purchasing and/or registering for any service provided on Savingaugustalittles.com, including any search and/or selection tools, you become a client ("Client") and you agree to be bound by the Terms.

IF YOU DO NOT AGREE TO THE TERMS, PLEASE DO NOT PURCHASE OR REGISTER FOR ANY SAVINGAUGUSTALITTLES.COM COURSES OR SERVICES OR ACCESS ANY MATERIALS, TOOLS OR PRODUCTS. IMPORTANT: THESE TERMS CONTAIN AN ARBITRATION PROVISION REQUIRING ALL CLAIMS TO BE RESOLVED BY WAY OF BINDING ARBITRATION.

Each time thereafter you access or use any of the courses, materials, tools, products or services provided on Savingaugustalittles.com, you signify your acceptance and agreement, without limitation or qualification, to be bound by the then current Terms.

Information retrieved from Savingaugustalittles.com, including but not limited to, any search results or car seat selections (collectively “Search Results”) is only intended for personal use and is for informational purposes only. You will be required to register with Savingaugustalittles.com in order to receive any Search Results.  You acknowledge that Search Results are for informational purposes only and are not intended to be a substitute for professional advice.  Search Results are subject to copyright and other proprietary rights of Website Owner and you agree you will not commit or permit any act or omission that would impair or infringe upon those rights.

Consulting Services: Talk to a Tech and Video Consults

By registering for, purchasing, or utilizing any consulting services provided by Savingaugustalittles.com, including but not limited to “Talk to a Tech” and “Video Consults,” you acknowledge and agree to the following:

Informational Purposes Only

All communications, recommendations, or guidance provided as part of these services are for informational purposes only and shall not be construed as legal, medical, or manufacturer-certified advice. The consulting services are not a substitute for professional guidance specific to your child, vehicle, or car seat. You agree to use such services at your own risk.

Savingaugustalittles.com and its owner do not warrant or guarantee the accuracy, completeness, or applicability of the information provided in these services and expressly disclaim any and all liability related to the use or misuse of such information. Clients are solely responsible for verifying proper car seat usage and installation per the relevant manufacturer’s instructions.

Scope of Services

Each service offering is limited to the scope expressly outlined on Savingaugustalittles.com. “Talk to a Tech” includes written communication only and may involve the review of user-submitted photos or videos. “Video Consults” consist of a scheduled live video session with a certified Child Passenger Safety Technician (CPST), during which general guidance may be provided. These services do not include:

• In-person car seat inspections or installations,

• Legal or regulatory interpretation,

• Ongoing support beyond the defined service period,

• Product liability assessments, or

• Manufacturer-specific certification or warranties.

Any attempt to use the service beyond its intended scope may result in immediate suspension or termination of access.

Right to Modify, Suspend, or Terminate

Savingaugustalittles.com reserves the right to modify, suspend, or terminate access to consulting services at any time and at its sole discretion, including but not limited to situations where:

• A user engages in abusive, inappropriate, harassing, or threatening conduct,

• A user requests assistance that is materially beyond the described scope of the service,

• Continued use poses a risk to the integrity or purpose of the services, or

• Operational, strategic, or legal considerations warrant discontinuation.

Access to a service may be revoked without notice and without refund. Savingaugustalittles.com also reserves the right to modify, pause, or permanently discontinue these services at any time without liability.

Limitations of Liability and Indemnification

BY PURCHASING AND/OR USING ANY SERVICES PROVIDED BY SAVINGAUGUSTALITTLES.COM, INCLUDING, BUT NOT LIMITED TO SEARCH RESULTS, YOU AGREE THAT IN NO EVENT WILL SAVINGAUGUSTALITTLES.COM, WEBSITE OWNER, ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSEES AND WEB HOSTING SERVICES WILL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT, INCIDENTAL, ACTUAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, SUCH DAMAGES WERE REASONABLY FORESEEABLE OR SUCH PARTIES WERE GROSSLY NEGLIGENT,  AS A RESULT OF YOUR ACCESSING THE SAVINGAUGUSTALITTLES.COM WEBSITE, PURCHASING ANY COURSE(S), AND/OR USING ANY OF THE SERVICES OR TOOLS AVAILABLE ON SAVINGAUGUSTALITTLES.COM. YOUR SOLE REMEDY FOR ANY BREACH OR DEFAULT OF THIS AGREEMENT BY SAVINGAUGUSTALITTLES.COM OR WEBSITE OWNER SHALL BE A RETURN OF ANY FEES PAID TO SAVINGAUGUSTALITTLES.COM OR WEBSITE OWNER FOR ANY COURSES, MATERIALS AND/OR SERVICES PROVIDED UNDER THIS AGREEMENT. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF WEBSITE OWNER, ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSEES, AND WEB HOSTING SERVICES, REGARDLESS OF THE FORM OF ACTION (WHETHER IN CONTRACT, TORT OR OTHERWISE), EXCEED THE AMOUNT YOU HAVE PAID TO WEBSITE OWNER FOR ANY COURSES, MATERIALS, AND/OR SERVICES OR TOOLS OUT OF WHICH SUCH LIABILITY AROSE. YOU INDEMNIFY AND AGREE TO DEFEND AND HOLD HARMLESS SAVINGAUGUSTALITTLES.COM, WEBSITE OWNER, ITS AND THEIR OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSEES AND WEB HOSTING SERVICES AND THIRD PARTIES FOR ANY LOSSES, COSTS, LIABILITIES AND EXPENSES (INCLUDING BUT NOT LIMITED TO COURT COSTS, LEGAL FEES, AWARDS OR SETTLEMENTS) RELATING TO OR ARISING OUT OF YOUR USE OF SAVINGAUGUSTALITTLES.COM, INCLUDING ANY BREACH BY YOU OF THESE TERMS.

Do Not Rely Solely on Savingaugustalittles.com

SEARCH RESULTS, OPINIONS, ADVICE, STATEMENTS OR OTHER COMMENTS SHOULD NOT BE THE ONLY THING RELIED UPON AS IT RELATES TO YOUR CAR SEAT(S) AND CHILD SAFETY AND ARE NOT TO BE CONSTRUED AS PROFESSIONAL ADVICE FROM SAVINGAUGUSTALITTLES.COM OR WEBSITE OWNER. SAVINGAUGUSTALITTLES.COM AND WEBSITE OWNER DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR CURRENTNESS, OF ANY OF THE INFORMATION PROVIDED.  

SAVINGAUGUSTALITTLES.COM AND WEBSITE OWNER ALWAYS RECOMMEND THAT YOU CONSULT YOUR CAR SEAT MANUFACTURER’S OWNER’S MANUAL AND ANY OTHER REFERENCE DOCUMENTS PROVIDED TO YOU WITH YOUR CAR SEAT(S).  SAVINGAUGUSTALITTLES.COM AND WEBSITE OWNER ARE NOT RESPONSIBLE FOR ANY LOSS RESULTING FROM YOUR RELIANCE ON SUCH INFORMATION.

Right to Monitor

Savingaugustalittles.com and Website Owner reserve the right, but are not obligated, to monitor materials posted in any public area and shall have the right to remove any information deemed offensive by our staff. Notwithstanding the foregoing, you remain solely responsible for your use of any information contained on the site.

Confidentiality

Any passwords used for this website are for the Client's individual use only. You will be responsible for the security of your password(s). From time to time, Savingaugustalittles.com may require that you change your password. You are prohibited from using any services or facilities provided in connection with this website to compromise its security or tamper with any of its system, resources, and/or accounts. The use or distribution of tools designed for compromising security (e.g., password crackers, rootkits, Trojan horses, or network probing tools) is strictly prohibited. If you become involved in any violation of system security, Savingaugustalittles.com or Website Owner reserve the right to release your account details to system administrators at other websites and/or the authorities in order to assist them in resolving security incidents. Savingaugustalittles.com and Website Owner reserve the right to fully cooperate with any law enforcement authorities or court order requesting or directing Savingaugustalittles.com to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate this Agreement.

Ownership, Copyrights, Trademarks, Licenses

Savingaugustalittles.com and Website Owner own and retain all proprietary rights to Savingaugustalittles.com, its courses, materials, trademarks, and copyrights. The information provided by Website Owner will continue to be the exclusive property of Website Owner.  Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information of Savingaugustalittles.com and Website Owner. The programs and software which operate this website are confidential trade secrets of Website Owner and therefore, you agree not to modify the tools, programs or any embodiment thereof or attempt to decipher, decompile, disassemble or reverse engineer the tools, programs or software or any embodiment thereof.

SAVINGAUGUSTALITTLES.COM AND ALL COURSES, MATERIALS, TOOLS, PRODUCTS, AND/OR SERVICES OFFERED THEREON ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SAVINGAUGUSTALITTLES.COM AND WEBSITE OWNER EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAVINGAUGUSTALITTLES.COM MAKES NO WARRANTY THAT (1) THE COURSES, MATERIALS, TOOLS. PRODUCTS AND/OR SERVICES WILL MEET YOUR REQUIREMENTS, (2) THE COURSES, MATERIALS, PRODUCTS, AND/OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (3) THE RESULTS OF USING THE COURSES, MATERIALS, TOOLS, PRODUCTS AND/OR SERVICES WILL BE ACCURATE OR RELIABLE, (4) THE QUALITY OF THE COURSES, MATERIALS, TOOLS, PRODUCTS AND/OR SERVICES WILL MEET YOUR EXPECTATIONS, OR (5) THAT ANY ERRORS IN THE SOFTWARE UTILIZED BY THE COURSES, MATERIALS, TOOLS, PRODUCTS AND/OR SERVICES WILL BE CORRECTED.

Jurisdiction and Dispute Resolution

This Agreement or any dispute arising from this Agreement is governed by the laws of Virginia, without regard to provisions of conflicts of law.  Any dispute, controversy, or claim arising out of or related in any manner to this Agreement which cannot be amicably resolved by the parties shall be solely and finally settled by arbitration administered by the American Arbitration Association in accordance with its commercial arbitration rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall take place before a panel of one (1) arbitrator sitting in Augusta County, Virginia.  The arbitration shall be in English. The arbitrator will be bound to adjudicate all disputes in accordance with the laws of the State of Virginia.  The decision of the arbitrator shall be in writing with written findings of fact and shall be final and binding on the parties. The arbitrator shall be empowered to award monetary damages, subject to the limitations set forth in these Terms, but shall not be empowered to award direct, indirect, incidental, special, or consequential damages or specific performance. Each party shall bear its own costs relating to the arbitration proceedings, irrespective of its outcome. This section provides the sole recourse for the settlement of any disputes arising out of, in connection with, or related to these Terms. Notwithstanding the foregoing, any action seeking injunctive relief shall be submitted to the courts and shall not be subject to this provision.  You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of Savingaugustalittles.com or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Severability

If any provision is found to be invalid or unenforceable, the remaining provisions of these Terms will be in full force and effect.

Certification

YOU MUST BE AT LEAST 18 YEARS OF AGE TO REGISTER, ACCESS, PURCHASE AND USE ANY COURSE, MATERIAL, TOOL AND/OR SERVICE PROVIDED BY THIS WEBSITE. IF YOU ARE UNDER THE AGE OF 18, DO NOT USE THIS WEBSITE FOR ANY PURPOSE.

Entire Agreement

The Terms set forth the entire understanding and agreement between you and Savingaugustalittles.com and Website Owner with respect to any services offered and/or provided on Savingaugustalittles.com or by Website Owner.

Waiver

The failure of Savingaugustalittles.com or Website Owner to exercise or enforce any right or provision of the Terms shall not operate as a waiver of such right or provision.  Any waiver of the Terms by Savingaugustalittles.com or Website Owner must be in writing and signed by an authorized representative of the Website Owner.
